Whether the respondent has taken advantage of a position of influence over the complainant may be a factor in determining consent. The objective of this regulation is to ensure compliance with Board Policy 2.1001 – Preventing and Responding to Domestic Violence, Dating Violence, Sexual Assault, and Stalking, the Campus Sa VE Act and the VAWA. The Sa VE Act seeks to address the violence women face on college campuses and updates the Jeanne Clery Act (Clery Act). New students and employees will receive information about sexual misconduct during orientation and during their first full semester at the College. “Sexual Assault” means any nonconsensual sexual act proscribed by Federal, tribal, or State law, including when the victim lacks capacity to consent.
